Item 1. Docket No. 98-1096-WEA. WEATHER MODIFICATION INC. for a Texas weather modification permit. The application requests authorization to conduct cloud-seeding operations within a target area that includes the portion of Real County east of U.S. 83 and all of the following counties: Bandera, Bexar, Blanco, Caldwell, Comal, Guadalupe, Hays, Kendall, Kerr, Medina and Uvlade. The operational area of the draft permit includes the following counties: Atascosa, Burnet, Frio, Gillespie, Kimble, Llano, Real, Wilson and Zavala. If granted, the permit will authorize weather modification activity through December 31, 2001. Hearings were held on the application on September 29, 1998 and October 1, 1998. Item 2. Docket No. 98-1037-MWD. Request by LAVON COUNTRY MEADOWS, LTD., for a new permit (proposed Permit No. 13962-001) to authorize the discharge of treated domestic wastewater at a daily average flow not to exceed 0.02565 million gallons per day (MGD) in the Interim I phase, 0.0513 MGD in the Interim II phase, and 0.07695 MGD in the Final phase. The wastewater treatment facility will serve a 114 unit mobile home park. The plant site is located approximately 2,500 feet northwest of the Community of Culleoka, immediately west of Farm-to-Market Road 982 and north of the Culleoka Baptist Church in Collin County, Texas. Item 3. Docket No. 98-1102-MWD. WINDERMERE OAKS WATER SUPPLY CORPORATION has applied to the Texas Natural Resource Conservation Commission (TNRCC) for an amendment of Permit NO. 11694-001 to increase flow (the application was processed as a renewal since all the technical information needed for an amendment was not completed). The permit will authorize the disposal of treated domestic wastewater effluent at a volume not to exceed a daily average flow of 40,000 gallons per day via irrigation of 24 acres of land. The wastewater treatment facilities and disposal site are located approximately 13 miles east of the intersection of State Highway 71 and U.S. Highway 281 in Burnet County, Texas. Item 4. Docket No. 98-1099-IWD. Application from HEREFORD BI-PRODUCTS, INC. for an amendment to Permit No. 01300 to increase the daily average flow to the evaporation ponds from 100,000 gallons per day to 800,000 gallons per day and to increase the effluent limitation for Biochemical Oxygen Demand (5-day) from 50 mg/l to 300 mg/l. The draft permit authorizes a discharge of process wastewater to evaporation ponds at a rate not to exceed a daily average flow of 350,000 gallons per day for rendering, pet food production and rawhide production, and not to exceed a daily flow of 3,280 gallons per day for hide curing. The draft permit authorizes a daily maximum Biochemical Oxygen Demand (5-day) limit of 250 mg/l. The applicant operates rendering plant that produces pet food, rawhide and cured hides. The facility is located 3.5 miles southwest of the City of Hereford on Highway 60, 4.2 miles southwest of the intersection of Highway 385 and Highway 60, and 3.5 miles northeast of the intersection of Farm to Market Road 1057 and Highway 60, Deaf Smith County, Texas. The site is located on 85 acres located within an approximate 350 acre site. The site is located adjacent to the east side of Old Georgetown Road, approximately 3 miles south of US Highway 84 and approximately 3 miles southwest of Gatesville in Coryell County. The Commission will consider the timely motions for reconsideration filed concerning the Executive Director's issuance of the registration. Consideration of the Administrative Law Judge's Proposal for Decision and Order concerning the City of Aledo's amendment to municipal wastewater discharge Permit No. 10847-01 to authorize an increase in average flow from 0.121 MGD to 0.350 MGD. The City also seeks a variance to the 150-foot buffer-zone requirements set out in Section 309.13 of the Commission's rules. (The ALJ recommends that the Commission issue the permit)
