Note
With few exceptions, the meetings and hearings on this page have
been requested by the public for the specific purpose of debating
permitting issues, such as whether a facility should be allowed to
obtain, renew, or amend a Texas Pollutant Discharge Elimination
System, New Source Review, or Municipal Solid Waste permit at a
specific location.
All of the meetings are arranged and conducted by the TCEQ's
Office of Public Assistance (OPA), which was charged on September
30, 1996, with providing the public access to
information--including the right to request meetings and
hearings--on most permitting applications handled by the TCEQ. Most
of the hearings, however, are arranged and conducted by the State
Office of Administrative Hearings (SOAH), which was created
expressly for that purpose.
This calendar only lists meetings and contested case hearings on
permitting cases. In addition, the SOAH hearings in this calendar
only announce the first notice, or preliminary hearing date, of a
case, and are posted purely as a courtesy to our customers. For
information on subsequent SOAH hearings, contact the Office of the Public

NOTICE OF COMPLETION OF TECHNICAL
REVIEW
AND DRAFT LICENSE
PROPOSED RADIOACTIVE MATERIAL LICENSE NUMBER R04100
AND NOTICE OF PUBLIC MEETING
APPLICATION AND PRELIMINARY DECISION. Waste
Control Specialists, LLC has applied to the Texas Commission on
Environmental Quality (TCEQ) for a radioactive material license to
authorize disposal of low-level radioactive waste. Waste Control
Specialists, LLC provides commercial hazardous waste and
radioactive material management and disposal services. The
application requests authorization to license a compact waste
disposal facility for disposal of low-level radioactive waste
subject to the Texas Low-Level Radioactive Waste Disposal Compact.
The application also requests authorization under a license for a
federal facility waste disposal facility for disposal of low-level
radioactive waste that is the responsibility of the federal
government. The application also requests exemption from a
Commission rule requirement in Title 30 Texas Administrative Code
§336.734(a), relating to the ownership of land on which
low-level radioactive waste is disposed. Specifically, Waste
Control Specialists, LLC requests exemption from the requirement
that the state or federal government own the land on which
low-level radioactive waste is disposed for the federal facility
waste disposal facility. The land disposal facility is proposed to
be located at 9998 West Highway 176 approximately one mile north of
State Highway 176 and one half mile east of the Texas-New Mexico
State boundary and approximately 30 miles west of the city of
Andrews in Andrews County, Texas. The application was submitted to
the TCEQ on August 4, 2004, and was originally processed as
proposed license number RW4100. The proposed license has been
re-designated as R04100 to conform to revised TCEQ coding
requirements.
The TCEQ Executive Director has completed the technical review
of the application and prepared a draft license. The draft license
if approved, would establish the conditions under which the
facility must operate. The Executive Director has made a
preliminary decision that this license, if issued, meets all
statutory and regulatory requirements. The Executive Director
prepared a written environmental analysis on the application that
is available to the public for review. The license application,
Executive Director's technical summary, environmental analysis, and
draft license are available for viewing and copying at the Andrews
County Library located at 109 Northwest First Street in Andrews,
Texas. The application, technical summary, draft license, and
environmental analysis are available at the offices of the TCEQ at

PUBLIC COMMENT/PUBLIC MEETING. The TCEQ will hold a
public meeting for this application. The purpose of a
public meeting is to provide the opportunity to submit comments or
to ask questions about the application. TCEQ holds a public meeting
if the Executive Director determines that there is a significant
degree of public interest in the application or if requested by a
local legislator. A public meeting is not a contested case hearing.
After the deadline for submitting public comments, the Executive
Director will consider all timely comments and prepare a response
to all relevant and material, or significant public comments on the
application, the draft license, the environmental analysis, or the
exemption request.
A public meeting will be held and will consist of two parts, an
Informal Discussion Period and a Formal Comment Period. During the
Informal Discussion Period, the public is encouraged to ask
questions of the applicant and TCEQ staff concerning the
application and the Executive Director's preliminary decision, but
these informal comments made during the informal period will not be
considered by the Commissioners before reaching a decision on the
application and no formal response will be made. During the Formal
Comment Period, members of the public may state their formal
comments into the official record. A written response to all formal
comments will be prepared by the Executive Director and considered
by the Commissioners before they reach a decision on the
application. A copy of the response will be sent to each person who
submits a formal comment or who requested to be on the mailing list
for this application and provides a mailing address. Only relevant
and material issues raised during the formal comment period can be

OPPORTUNITY FOR A CONTESTED CASE HEARING. A
contested case hearing is a legal proceeding similar to a civil
trial in a state district court. The TCEQ may grant a contested
case hearing on this application if a written hearing request is
timely submitted.
TO REQUEST A CONTESTED CASE HEARING, YOU MUST INCLUDE
THE FOLLOWING ITEMS IN YOUR REQUEST: your name, mailing address,
phone number; applicant's name and license number; the location and
distance of your property/activities relative to the facility; a
specific description of how you would be adversely affected by the
facility in a way not common to the general public; and, the
statement "[I/we] request a contested case hearing." If the request
for contested case hearing is filed on behalf of a group or
association, the request must designate the group's representative
for receiving future correspondence; identify an individual member
of the group who would be adversely affected by the facility or
activity; provide the information discussed above regarding the
affected member's location and distance from the facility or
activity; explain how and why the member would be affected; and
explain how the interests the group seeks to protect are relevant
to the group's purpose.
Following the close of all applicable comment and request
periods, the Executive Director will forward the application and
any requests for reconsideration or for a contested case hearing to
the TCEQ Commissioners for their consideration at a scheduled
Commission meeting.
EXECUTIVE DIRECTOR ACTION. The Executive
Director may issue final approval of the application unless a
timely contested case hearing request or request for
reconsideration is filed. If a timely hearing request or request
for reconsideration is filed, the Executive Director will not issue
final approval of the permit and will forward the application and

APPLICATION. U.S. Ecology Texas, Inc., 3277
County Road 69, Robstown, Nueces County, Texas 78380, has applied
to the Texas Commission on Environmental Quality (TCEQ) for a Class
3 Modification to a Permit and Compliance Plan. The permit
modification requests authorization to increase disposal capacity
by the addition of a new Cell within the existing hazardous waste
landfill (Permit Unit No. 1), for disposal of solid wastes that
meet or have been treated to meet the Land Disposal Restrictions.
The proposed landfill cell has been designated as Cell 50. The
compliance plan modification requests the removal and/or relocation
of existing monitoring wells and piezometers to allow for
construction of Cell 50. The facility is located at the address

The TCEQ Executive Director has reviewed this action for
consistency with the goals and policies of the Texas Coastal
Management Program (CMP) in accordance with the regulations of the
Coastal Coordination Council (CCC) and has determined that the
action is consistent with the applicable CMP goals and
policies.
The TCEQ Executive Director has determined the application is
administratively complete and will conduct a technical review of
the application. After technical review of the application is
complete, the Executive Director may prepare a draft

APPLICATION. NRG Texas Power LLC, 1301 McKinney
Street, Suite 2300, Houston, Texas 77010, has applied to the Texas
Commission on Environmental Quality (TCEQ) for issuance of
Hazardous Air Pollutant Major Source [FCAA § 112(g)] Permit
Number HAP-14, which would establish case by-case Maximum
Achievable Control Technology (MACT) requirements for the Limestone
Electric Generating Station - Unit 3 Boiler and auxiliary boiler
located approximately nine miles north of Jewett on Farm-to-Market
Road 39 in Limestone County, Texas. A case-by-case MACT analysis
was completed to establish case-by-case MACT limits for the Unit 3
pulverized coal boiler and auxiliary boiler. Draft Permit Number
HAP-14 establishes federally enforceable MACT emission limitations
for carbon monoxide (CO) (CO is a surrogate for organic hazardous
air pollutants [HAPs]), filterable particulate matter (PM) (PM is a
surrogate for non-mercury HAP metals), hydrogen fluoride, hydrogen
chloride, and mercury.
The proposed facility authorized by draft Permit Number HAP-14
is also subject to State Air Quality and Federal Prevention of
Significant Deterioration (PSD) preconstruction permitting
requirements. The TCEQ has prepared draft State Air Quality Permit
Number 79188 and PSD Air Quality Permit Number PSD-TX-1072, which
establishes additional conditions under which the proposed facility
must operate. Based on a formal de minimis (netting) demonstration
filed by NRG Texas Power LLC on May 12, 2008, the proposed facility
will not emit nitrogen oxides (NOx) or sulfur dioxide (SO2) in a
significant amount and is no longer subject to PSD review for NOx
or SO2.
The TCEQ executive director has prepared a draft permit which,
if approved, would establish the conditions under which the
facility must operate. The TCEQ Executive Director has made a
preliminary decision to issue the permit. The permit applications,
TCEQ Executive Director's preliminary decisions, and draft Permit
Number HAP-14, State Air Quality Permit Number 79188, and PSD Air
Quality Permit Number PSD-TX-1072 are available for viewing and
copying at the TCEQ Central Office, the TCEQ Waco Regional Office,
and at the Limestone County Courthouse, 200 West State Street,
Groesbeck, Limestone County, Texas. The facility's compliance file,

APPLICATION. Wise Service Company - Water, P.O.
Box 269, Decatur, Texas 76234-0269, has applied to the Texas
Commission on Environmental Quality (TCEQ) for a new permit,
proposed Texas Pollutant Discharge Elimination System (TPDES)
Permit No. WQ0014708001, to authorize the discharge of treated
domestic wastewater at a daily average flow not to exceed 75,000
gallons per day. The facility will be located approximately 3.75
miles north northwest of the intersection of U.S. Highway 380 and
Farm-to-Market Road 730 and approximately 1.4 miles east of the
intersection of U.S. Highway 287 and County Road 2175 in Wise
County, Texas.
The treated effluent will be discharged via pipeline to an
unnamed tributary; thence to an unnamed reservoir; thence to an
unnamed tributary; thence to Watson Branch; thence to Sandy Branch;
thence to West Fork Trinity River Below Bridgeport Reservoir in
Segment No. 0810 of the Trinity River Basin. The unclassified
receiving water uses are no significant aquatic life uses for the
unnamed tributary and high aquatic life use for the unnamed
reservoir. The designated uses for Segment No. 0810 are high
aquatic life use, public water supply and contact recreation. In
accordance with §307.5 and the TCEQ implementation procedures
(January 2003) for the Texas Surface Water Quality Standards, an
antidegradation review of the receiving waters was performed. A
Tier 1 antidegradation review has preliminarily determined that
existing water quality uses will not be impaired by this permit
action. Numerical and narrative criteria to protect existing uses
will be maintained. A Tier 2 review has preliminarily determined
that no significant degradation of water quality is expected in the
unnamed reservoir, which has been identified as having high aquatic
life uses. Existing uses will be maintained and protected. The
preliminary determination can be reexamined and may be modified if
new information is received.

Proposed Permit No. WQ0010161002
APPLICATION. The City of Dumas, P. O. Box 438,
Dumas, Texas 79029-0438, has applied to the Texas Commission on
Environmental Quality (TCEQ) for a new permit, proposed TPDES
Permit No. WQ0010161002, to authorize the discharge of treated
domestic wastewater at an annual average flow not to exceed
1,940,000 gallons per day. The facility will be located
approximately one mile east of U.S. Highway 287 and south of the
City of Dumas on East 19th Street in Moore County, Texas. This
application was submitted to the TCEQ on March 22, 2007.
The treated effluent will be discharged to an unnamed tributary;
then to an unnamed tributary; then to a reservoir; then to an
unnamed tributary; then to Coon Lake; then to an unnamed tributary;
then to Big Blue Creek; then to Lake Meredith in Segment No. 0102
of the Canadian River Basin. The unclassified receiving water uses
are no significant aquatic life uses for the unnamed tributaries
and reservoir. The designated uses for Segment No. 0102 are
exceptional aquatic life uses, public water supply, and contact
recreation. In accordance with 30 Texas Administrative Code (TAC)
Section (§) 307.5 and the TCEQ implementation procedures
(January 2003) for the Texas Surface Water Quality Standards, an
antidegradation review of the receiving waters was performed. A
Tier 1 antidegradation review has preliminarily determined that
existing water quality uses are not expected to be impaired by this
permit action. Numerical and narrative criteria to protect existing
uses are expected to be maintained. This review has preliminarily
determined that no water bodies with exceptional, high, or
intermediate aquatic life uses are present within the stream reach
assessed; therefore, no Tier 2 degradation determination is
required. No significant degradation of water quality is expected
in water bodies with exceptional, high, or intermediate aquatic
life uses downstream, and existing uses are expected to be
maintained and protected. The preliminary determination can be
reexamined and may be modified if new information is received.
The TCEQ Executive Director has prepared a draft permit which,
if approved, would establish the parameters and limitations within
which the facility must operate. The Executive Director has made a
preliminary decision that this permit, if issued, meets all
statutory and regulatory requirements. The permit application,

APPLICATION. URI, Inc., 405 State Highway 121
Bypass, Building A, Suite 110, Lewisville, Texas 75067, an in-situ
uranium mining company, has applied to the Texas Commission on
Environmental Quality (TCEQ) for an aquifer exemption. An aquifer
or portion of an aquifer may be designated as an exempted aquifer
if it does not currently and will not in the future serve as a
source of drinking water for human consumption for the following
reasons: (a) the aquifer is capable of producing mineral,
hydrocarbon or geothermal energy; (b) the aquifer is at a depth or
location that makes recovery of water for drinking water purposes
economically or technically impractical; (c) the aquifer is so
contaminated that it would be economically or technologically
impractical to render that water fit for human consumption; or (d)
the aquifer is located above a Class III well mining area subject
to subsidence or catastrophic collapse.
TCEQ rules in 30 Texas Administrative Code § 331.2 (105)
define an underground source of drinking water as an aquifer or
portion of an aquifer that supplies drinking water for human
consumption or in which the groundwater contains fewer than 10,000
mg/l total dissolved solids and which is not an exempted aquifer.
Because the production/injection zone under URI's current in-situ
uranium mining permit UR02080 contains groundwater with less than
10,000 mg/l total dissolved solids, URI must acquire an aquifer
exemption before URI can produce uranium from the
production/injection zone.
The proposed aquifer exemption is for the Rosita mine extension
in Duval county, approximately 11 miles northwest of the City of
San Diego, southwest of the intersection of SH 44 and FM 3196, in
the A.B.&M. Survey, Abstract-8 and Abstract-373. The aquifer
exemption would include the production zone and the interval in the
Goliad Formation with an aerial extent of approximately 200 acres
and a depth ranging from 80 to 260 feet below the surface.
The TCEQ Executive Director has completed the technical review
of the application and has made a preliminary decision that the
application for aquifer exemption meets all regulatory
requirements. If approved by the TCEQ, the Executive Director will
prepare an application to the U.S. Environmental Protection Agency
(EPA) to revise the state's Underground Injection Control program
to reflect the exemption of the relevant portion of the aquifer.
The exemption would remain in effect until exemption status is
removed. EPA must approve designation of an exempted aquifer for
TCEQ's approval to be final.

APPLICATION. H Bowers, Inc., Rural Route 1, Box
534, Palacios, Texas 77465, which proposes to operate a shrimp and
catfish processing facility, has applied to the Texas Commission on
Environmental Quality (TCEQ) for a new permit, Proposed Permit No.
WQ0004815000 to authorize the disposal of process wastewater from a
fish and shrimp processing facility at a daily average flow not to
exceed 102,740 gallons per day via irrigation of 36.5 acres of
Coastal Bermuda and Rye grasses. The application rate shall not
exceed 3.2 acre-inches/acre-irrigated/month. This permit will not
authorize a discharge of pollutants into water in the State.
The facility is located 3.5 miles north of the City of Palacios
Texas on Highway 35, 1000 feet south of the intersection of Highway
35 and FM 521, Matagorda County, Texas. The facility and disposal
site are located in the drainage area of Tres Palacios / Turtle Bay
in Segment No. 2452 of the Bays and Estuaries.
The TCEQ executive director has prepared a draft permit which,
if approved, would establish the conditions under which the
facility must operate. The Executive Director has made a
preliminary decision that this permit, if issued, meets all
statutory and regulatory requirements. The permit application,

The Texas Commission on Environmental Quality (TCEQ) proposes to
issue a general permit (Texas Pollutant Discharge Elimination
System Permit No. TXG500000) authorizing the discharges of process
wastewater, mine dewatering, storm water associated with industrial
activity, construction storm water, and certain non-storm water
discharges from quarries located greater than one mile from a water
body that is within a water quality protection area in the John
Graves Scenic Riverway. General permits are authorized by Section
26.040 of the Texas Water Code.
PROPOSED GENERAL PERMIT. The Executive Director
has prepared a draft permit that authorizes the discharges of
process wastewater, mine dewatering, storm water associated with
industrial activity, construction storm water, and certain
non-storm water discharges from quarries located greater than one
mile from a water body that is within a water quality protection
area in the John Graves Scenic Riverway. This general permit
requires quarries located greater than one mile from a water body
that is within a water quality protection area in the John Graves
Scenic Riverway to submit a Notice of Intent (NOI), Pollution
Prevention Plan, Restoration Plan, and proof of financial assurance
for Restoration to obtain authorization for discharge. No
significant degradation of high quality waters is expected and
existing uses will be maintained and protected.
