The rules or ordinances local government uses to review and
approve these developments are promulgated by the Texas Attorney
Generals Red Book
. These laws, which are intended to
prevent the formation of new colonias, take a variety of forms and
apply in a variety of circumstances. The Texas Legislature has
refined these laws during the past 15 years. Some of the major laws
apply only in the border area or in economically
distressed counties with high unemployment and low per-capita
income.

How often do the OSSF rules
change?
The rules are reviewed every four years for their effectiveness
and clarity.
A decision is made if a change in the rules is needed. If a
change is needed:
- The proposed change (along with any others proposed) is posted
in the Texas Register for public comment.
- The proposed changes are mailed out to all the
local permitting authorities for public review.
- Within six months from the date the notice for public comment
is given:

- the proposed changes are revised in response to public comment
and adopted, or
- the process starts over.
