Concrete Production Facility Discharges: Obtaining Coverage Under General Permit No. TXG110000

If you own or operate a ready-mixed concrete plant, concrete products plant, or their associated facilities (SIC Codes 3271, 3272, and 3273), and discharges facility wastewater, contact storm water, or both into or adjacent to water in the state, a permit is required. You may qualify for coverage under the Concrete Production Facility, General Permit (TXG110000).

NOTE: Effective September 1, 2017, applicants must submit the application forms using the online e-permitting system or request and obtain an electronic reporting waiver. Electronic reporting waivers are not transferable and expire on the same date as the authorization to discharge.

You must obtain authorization before discharging from a concrete production facility. The following steps will help determine if you qualify for coverage under this general permit:

  1. Read the general permit (TXG110000) Microsoft Word Document to make sure it applies to your discharge.
    • If the general permit does not apply, you may need to obtain an individual permit.
    • If the general permit does apply, continue with Step 2.
  2. Review your facility's compliance history ranking.
    • If your facility has a ranking of "high," "satisfactory," or "inadequate information" continue to Step 3.
    • If the ranking is "unsatisfactory," your facility is not eligible for coverage under a general permit. You must apply for an individual permit instead.

Complying With Your Permit

After obtaining coverage:

  • Adhere to the requirements of the general permit.
  • Submit the online Discharge Monitoring Report, as required.
  • Submit the online Notice of Change (NOC) if you failed to submit any relevant facts, submitted incorrect information in an NOI, or if any previously submitted information has changed.
  • Submit the online Notice of Termination (NOT) when all discharges authorized by the permit are eliminated, completed, if the operator or owner changes, or coverage under an individual permit is obtained.

NOTE: If you are discharging to an MS4, you must submit a copy of the NOI, NOC, and/or NOT to the operator of that system at the same time you submit the forms to TCEQ.

Annual Fees

Coverage continues to be active until a Notice of Termination is submitted. Annual water quality fees of $500 will accrue on September 1st of each year that the permit is active. An invoice for the annual fees will be mailed each year to the billing contact identified in your application.
