Renewed Construction Storm Water General Permit TXR150000: What to Do

Construction Storm Water Permits Not Renewed By June 3, 2008 Have Expired:

Use the Water Quality General Permits Authorization and Application Query to:

  • Determine if your renewal application has been processed. Once processed this will be located at the bottom of the permit information page as an NOI-Renewal.

  • Determine if your application for a new permit has been processed. Use the Advanced Search feature to do this.

*The status of expired permits will show Active until processing of all paper applications is complete. Please allow 8-12 weeks for processing.

If your construction storm water permit has expired, and you still need coverage, you will need to apply for a new permit. Permits which have expired are not eligible to be terminated. Do not submit a Notice of Termination.

Key Dates:

The construction general permit, TXR150000, is re-issued every five years. The March 5, 2003 issuance of the permit expired on March 5, 2008.

  • TCEQ approved the permit February 13, 2008.

  • The permit took effect March 5, 2008.

  • Renewal was required by June 3, 2008.

  • The permit expires March 5, 2013.

Important Changes:

  • No annual billing of Water Quality Fee.

  • New application fees must be paid to obtain a new permit and to renew an existing permit:
    • $325 for paper Notice of Intent (NOI). If you sign and submit the NOI on paper, it is a “paper NOI.”

    • $225 for online ePermits NOI. The NOI must be completed, signed, and submitted online to qualify.

  • New dates of provisional coverage also depend on how you submit the NOI:
    • Starts 7 days later, if by paper

    • Starts immediately, if online

  • Change in the definition of “construction site operator.” Read the renewed TXR15000 for details.

  • Changes to Storm Water Pollution Prevention Plan (SWP3) requirements. Read the renewed general permit for details.

Note: A Notice of Change is not available in ePermits at this time. For now, use the paper Notice of Change (form TCEQ-20391). For all other applications, follow these steps:

  1. Get a STEERS electronic reporting account

  2. Go to STEERS login page (ePermits online application)

  3. Log in and select the ePermitting program area.

  4. Select the “I want to Create an application” button and then:

    • To get a new permit: Select application type: “Create a new CNOI application for Notice of Intent.” Complete each section of the application in the order listed on the left side of window, clicking the NEXT button to save your work and move to the next page.

    • To terminate a permit: Select application type: “Terminate an existing CNOI authorization.” Enter the Permit number. Confirm you are terminating the correct permit. Select the reason.

  5. To complete your application (new permit, terminations): Return to the “Activities” page and select your permit application(s) that need to be edited, or that you want to view, or applications that are ready to sign, pay, or submit, or to add another persons account for access to the application. Finally, print and save all of the following information:

    • the application submitted to us (referred to as a Copy of Record (COR)),

    • the acknowledgment certificate, and

    • the cover letter.
