Notice of Rule Stakeholder Meeting Concerning Environmental Flow Standards
House Bill (HB) 3 and Senate Bill (SB) 3, 80th Legislature, 2007, require the Texas Commission on Environmental Quality (TCEQ) to adopt by rule appropriate environmental flow standards for each river basin and bay system in the state. The adoption schedule, as amended, requires environmental flow standards for the river and bay systems consisting of the Sabine and Neches Rivers and Sabine Lake Bay, and the Trinity and San Jacinto Rivers and Galveston Bay to be adopted by June 1, 2011.
To comply with HB 3/SB 3, TCEQ staff is proposing the creation of new 30 Texas Administrative Code Chapter 298, Environmental Flows, Subchapter A, Sabine and Neches Rivers and Sabine Lake Bay; and Subchapter B, Trinity and San Jacinto Rivers and Galveston Bay.
Reminder of Rule Stakeholder Meeting Concerning Environmental Flow Standards.
The TCEQ is holding a rule stakeholder meeting to obtain input from the public on the rulemaking required by HB 3/SB 3 for the river and bay systems consisting of the Sabine and Neches Rivers and Sabine Lake Bay, and the Trinity and San Jacinto Rivers and Galveston Bay.
The rule stakeholder meeting will be held on Thursday, August 12, 2010, at 1:00 p.m., at TCEQ’s Offices at 12100 Park 35 Circle, Building E, Room 201, Austin, Texas. If you are unable to attend the scheduled meeting, you may submit your comments in writing to Ron Ellis, Texas Commission on Environmental Quality, P.O. Box 13087, MC 160, Austin, Texas 78711-3087, (512) 239-1282, or roellis@tceq.state.tx.us. Please note that we will accept written comments through Thursday, August 19, 2010.
The rule stakeholder meeting will be webcast at the Texas Admin
website.
Please note that this is an opportunity to provide informal comments to staff prior to the formal rulemaking process. A formal public rule hearing and comment period is planned for December, 2010.
Environmental Flow Recommendations
The Final Recommendations Report from the Sabine and Neches Rivers and Sabine Lake Bay Basin and Bay Area Stakeholder Committee can be found here.
Basin and Bay Area Stakeholder Committee (BBASC)
The Texas Water Code requires the creation of several Basin and Bay Areas Stakeholder Committees for specific river basin and bay systems listed in the Texas Water Code §11.02362
. ( map: geographical extent of priority basins).
These Committees have specific tasks to perform to assist with the work of the Environmental Flows Advisory Group. One of the tasks the Committees are to perform is to establish a Basin and Bay Expert Science Team. Each Basin and Bay Expert Science Team will develop an environmental flow analyses and a recommended environmental flow regime for their specific river basin and bay system.
