Site Background:

The Aztec Mercury site is located at 970 Callaway Drive,at the corner of Callaway Drive and West Dumble Street in Alvin. From 1974 to 1985, mercury was recycled at this site. An enforcement order issuedby the Texas Water Commission on May 13, 1986, required operations to cease.

Directions: At TCEQ Austin, parking for visitors and the handicapped is available on the east side of Building D near IH-35 and on the west side of Building E, convenient to wheelchair access ramps that are between Building D and Building E.

Superfund Actions Taken to Date: (skip to the most current action)
  • October 16, 1987, a legal notice was published in the Texas Register (12 TexReg 3858-3859) proposing the site to the state Superfund registry and announcing that a public meeting to receive citizen comments would be held at the Pasadena Convention Center on November 4, 1987.
  • September 1, 1993, effective date of the creation of the Texas Natural Resource Conservation Commission from the joining of the Texas Water Commission and the Texas Air Control Board and a portion of the Texas Department of Health.
  • January 22, 1988, a legal notice was published in the Texas Register (13 TexReg 427-428) listing the site on the state Superfund registry.
  • April 13, 1990, remedial investigation/feasibility study under way.
  • July 8, 1994, TNRCC approved the remedial investigation report as submitted.
  • July 14, 1994, the soil, sediment unit was separated from the groundwater unit so that focused cleanup remedies could proceed more rapidly. The result of the separation was completion of the remedial investigation/feasibility study phase for the soil, sediment unit.
  • August 30, 1994, TNRCC accepted and approved the final baseline risk assessment report.
  • August 31, 1994, TNRCC accepted the final feasibility study report that evaluated several remedial options for cleaning up the soils and sediment. Based on the feasibility study, the recommended remedial option was excavation and offsite disposal of contaminants.
  • October 17, 1994, a legal notice was published in the Alvin Sun-Advertiser announcing a public meeting would be held December 8, 1994, at Alvin Junior High School to present to the community the best choice among cleanup remedies and to receive citizen comments on the final recommended remedy.
  • October 18, 1994, a legal notice was published in the Texas Register (19 TexReg 8313) announcing a public meeting would be held December 8, 1994, at Alvin Junior High School to present to the community the best choice among cleanup remedies and to receive citizen comments on the final recommended remedy.
  • December 8, 1994, a public meeting was held at Alvin Junior High School to receive comments on the proposed cleanup alternative for the soil unit, which was excavation and off-site disposal. The completion of the remedial investigation/feasibility study for the groundwater unit is pending completion of removal of the soil.
  • September 29, 1995, TNRCC issued a unilateral administrative order directing the potentially responsible party to perform the remedial design and remedial action at the site. The unilateral administrative order was effective immediately.
  • September 1997, remedial action for the soil, sediment unit underway.
  • March 3, 1998, an affidavit of lien payable to the commission was filed in the Brazoria County real property records by the TNRCC. The lien was filed pursuant to the Texas Solid Waste Disposal Act, Texas Health and Safety Code §361.194, to recover the state's remediation expenses.
  • March 13, 1998, TNRCC approved the final remedial action report. See addendum: April 9, 2002
  • July 3, 1998, a legal notice was published in the Texas Register (23 TexReg 7135-7136) proposing to delete the site from the state Superfund registry in accordance with 30 TAC §335.344(c) and inviting public comment on the determination that the site no longer presents an imminent and substantial threat to public health and safety or the environment.   • July 6, 1998, a legal notice was published in the Alvin Sun, proposing to delete the site from the state Superfund registry in accordance with 30 TAC §335.344(c), and inviting public comment on the determination that the site no longer presents an imminent and substantial endangerment to public health and safety or the environment. No further remedial action planned.
  • August 28, 1998,  a legal notice was published in the Texas Register (23 TexReg 8915), officially deleting Aztec Mercury from the state Superfund registry in accordance with 30 TAC §335.344(c). No challenges or comments were received on the determination that the site no longer presents an imminent and substantial endangerment to public health and safety or the environment.   • April 9, 2002: Addendum to March 13, 1998, information. The report confirmed that as a result of the removal action of soil and sediment, there was no longer a source for groundwater contamination, and the site no longer presented an endangerment to public health or the environment and is suitable for residential use.
  • September 1, 2002, effective date of the name change from Texas Natural Resource Conservation Commission (TNRCC) to Texas Commission on Environmental Quality (TCEQ).
