Site Background:
The Cox Road Dump site in Dayton also known as Liberty Waste
Disposal Company was operated as an industrial waste disposal
facility from 1969 until 1983. The landfill is 83 acres on the west
side of County Road 491 (Cox Road) about one mile north of FM 1413.
The site was originally used to landfill tank bottoms and filter
cake from petroleum companies, using a trench and fill method. The
trenches used to dispose of the wastes were originally 18 to 20
feet deep and penetrated the shallow water-bearing zone. The water
level was documented at 13 to 15 feet below ground surface. When
industrial solid waste regulations became effective in 1970, the
landfill operations were limited to a depth of 8 feet and a
landfarm operation was initiated. At the close of operations, the
landfill was capped with soil dug up from a portion of the site.
Since then, the three-foot layer of topsoil has been eroded and the
buried waste has been exposed. Runoff from the site drains into the
Trinity River through a series of ditches that criss-cross the
property. Analytical results of soil and water samples indicate the
presence of arsenic, barium, boron, chromium, lead, and mercury.
Also detected were Aroclor 1016, cadmium, cobalt, cyanide, phenol,
toluene, xylene, and the pesticide 4,4-DDE.

- February 9, 2006, letters requesting good faith
offers were mailed to the potentially responsible parties.
- February 10, 2006, a legal notice was published in the
Texas Register (31 TexReg 907–908) describing the
site, proposing
the site for listing on the state Superfund registry and the
identification of potentially responsible parties. TCEQ will use
nonresidential land criteria in setting cleanup levels.
Nonresidential land use would be based on the existing land use of
the property as is prescribed in 30 TAC Chapter 350, Texas Risk

- March 14, 2005, a health consultation document was prepared for
the Cox Road Dump site by the Texas Department of State Health

- March 16, 2006, more than 130 interested citizens attended a
public meeting at the Dayton High School. The meeting was to
receive comments on the proposal to list the Cox Road Dump site on
the Superfund registry and the use of commercial/industrial land
use specifications for remediation of the site contamination.
- April 17, 2006, the Texas Commission on Environmental Quality
was notified by potentially responsible parties of their intent to
conduct a remedial investigation under the Voluntary Cleanup
Program.
- May 16, 2006, The Texas Commission on Environmental Quality Voluntary Cleanup Program
completed the review of the application and assigned a project

- May 24, 2006, legal notices were published in the Dayton
News, Cleveland Advocate, and the Liberty
Vindicator, proposing to delete the site from the state
Superfund registry in accordance with 30 TAC §335.344(c) and
inviting public comment on the determination that the site has been
accepted into the TCEQ Voluntary Cleanup Program. A public meeting
is scheduled June 29, 2006, at the Dayton High School cafeteria,
3200 North Cleveland, Dayton.
- May 26, 2006, a legal notice was published in the Texas
Register (31 TexReg 4506) proposing to delete the site from
the state Superfund registry in accordance with 30 TAC
§335.344(c) and inviting public comment on the determination
that the site has been accepted into the TCEQ Voluntary Cleanup

- June 15, 2006, notices were published in the Dayton
News, Cleveland Advocate, and the Liberty
Vindicator, inviting public comment on the determination that
the responsible parties will assume cleanup responsibilities under
the TCEQ Voluntary Cleanup Program and the site will be deleted
from the Superfund registry. Upon deletion from the Superfund
registry, the site will carry the designation VCP 1922. A public
meeting is scheduled June 29, 2006, at the Dayton High School
cafeteria, 3200 North Cleveland, Dayton.
- August 25, 2006, a legal
notice was published in the Texas Register, (31 TexReg 7021),
officially deleting the site from the state Superfund registry in
accordance with 30 TAC §335.344(c) and 30 TAC
§361.189(a). The site was accepted into the Voluntary Cleanup
Program. In accordance with Texas Health and Safety Code
§361.188(d), a notice will be filed in the real property
records of Liberty County stating that the site has been deleted
