Site Background:

The Harkey Road site is located at 17111 Harkey Road in an unincorporated section of Brazoria County, approximately 2 miles south of the City of Pearland. The site, approximately 2/3 acre in size, is currently abandoned and fenced with posted warning signs. The fenced area consists of Lots 4 and 5 in Hasting Acres. The description of the site is based on information available at the time the site was evaluated with the Hazard Ranking System (HRS). The site was formerly owned by the late George Hastings and Nola Hastings. The contaminant is lead, believed to be from lead-acid battery chips placed on the property to backfill low areas. Between August 2000 and January 2001, a site investigation was conducted by the TNRCC. One mobile home, one utility shed and one propane tank were removed from the fenced area

Directions: At TCEQ Austin , parking for visitors and the handicapped is available on the east side of Building D near IH-35 and on the west side of Building E, convenient to wheelchair access ramps that are between Building D and Building E.


Superfund Actions to Date:

  • November 22, 1997, a site perimeter fence was constructed to limit unauthorized access and signs were posted warning of contamination.

  • April 25, 2001, legal notices were published in the Pearland Journal and the Pearland Reporter News describing the site, proposing the site for listing on the state Superfund registry, and announcing that a public meeting to receive citizen comments would be held at the H.C. Carleston Elementary School in Pearland on June 4, 2001.
  • April 27, 2001, a legal notice was published in the Texas Register (26 TexReg 3252-3253) describing the site, proposing the site for listing on the state Superfund registry, and announcing that a public meeting to receive citizen comments would be held at the H.C.   • June 4, 2001, a public meeting was held at the H.C. Carleston Elementary School in Pearland on the proposal of the Harkey Road site to be listed on the Superfund registry.

  • May 5, 2001, TNRCC issued a work order to a state contractor to meet and discuss the scope of remedial actions that need to be taken at the site.
  • June 1, 2001, TNRCC issued a work order amendment to conduct sampling for a treatability study and a work plan for excavation and disposal of lead-contaminated soil and debris found in residential yards, which initiated the remedial investigation at the site.
  • June 28, 2001, TNRCC issued a work order amendment to perform a removal action and dispose of contaminated soil, install monitor wells and sample the groundwater.
  • July 10-August 16, 2001, TNRCC's contractor excavated and stabilized the uppermost 18 inches of contaminated soils. Fifty-six truck loads of stabilized soil were transported to an authorized landfill for disposal. The contractor also installed three monitor wells which were in addition to and existing monitor well. Grondwater samples were collected from the monitoring wells and were sent to a lab for analysis.
  • August 18, 2001, TNRCC's contractor completed demobilization of excavation equipment. The removal action was substantially complete.
  • December 3, 2001, TNRCC issued a work order to the contractor to visually inspect the neighboring properties and to remove any battery chips that were found.
  • January 14-15, 2002, the visual inspection of neighboring properties and removal of ground battery chips was completed.
  • February 14, 2002, an affidavit of lien payable to the commission was filed in the Brazoria County real property records by the TNRCC. The lien was filed pursuant to the Texas Solid Waste Disposal Act, Texas Health and Safety Code §361.194, to recover the state's remediation expenses
  • April 5, 2002, a legal notice was published in the Texas Register (27 TexReg 2887-2888) proposing to delete the site from the state Superfund registry in accordance with 30 TAC §335.344(b), and inviting public comment on the determination that the site no longer presented an imminent and substantial threat to public health and safety or the environment. Future use of the site is considered appropriate for residential use. No further remedial action is planned. [Read the text of the legal notice in PDF. (Help with PDF.) The PDF file does not include illustrations or copies of documents cited.] A public meeting was scheduled for May 7, 2002, at the H.C. Carleston Elementary School.
  • May 7, 2002, a public meeting was held at the H.C. Carleston Elementary School to receive comments from the community on the intent to delete the site from the Superfund registry, and the determination that the site no longer presented an imminent and substantial endangerment to public health and safety or the environment.
  • May 20, 2002, the TNRCC project manager reported that cleanup was complete, and conditions at the site met residential cleanup standards. No further remedial action was planned for the Harkey Road site.
  • June 5, 2002, TNRCC performed a final sampling of the monitoring wells in response to a special request from a county official. Results reconfirmed that groundwater posed no health risk to the public, and the monitoring wells were plugged and abandoned.
  • July 26, 2002, a legal notice was published in the Texas Register (27 TexReg 6754-6755) officially deleting the Harkey Road site from the state Superfund registry in accordance with 30 TAC §335.344(b). It was determined that the site no longer presented an imminent and substantial endangerment to public health and safety or the environment. [Read the text of the legal notice in PDF.   • September 1, 2002, effective date of the name change from Texas Natural Resource Conservation Commission (TNRCC) to Texas Commission on Environmental Quality (TCEQ).
